Picture this: A 16 year old girl who is visibly intoxicated, with slurred speech, she is sexually assaulted by a 16 year old boy during a pajama party. He was drunk and filmed the incounter with his cell phone, later showing it to friends and sending a text saying ” When your first time having sex is rape”. One would think this is pretty damming evidence, but not in the hands of one family court judge. Judge James Troiano of Superior Court sounded like the boys Uncle or at least a friend of family as he cited reasons he was ruling aganist trying the 16 year old as an adult. The judge said it wasn’t rape, defining that as something reserved for an attack at gunpoing by strangers. He even question if it was actually sexual assault. But he didn’t stop there he went on to say that the young man came from a good family, was an Eagle Scout with good grades and was probably a candidate for a good college. According to prosecutors, Troiano also said someone should have explained to the girl and her parents that pressing charges would destroy the boys life. But what about the girls life? she was violated in a number of ways physically and emotionally both of these kids made mistakes that night by drinking, but only one took advantage of the other. I don’t know if the term “good family” means a wealthy family but thankfully the New Jersey Court of Appeals believes that justice is blind, and has cleared the way for the case to be moved from family court to a grand jury where the teenager will be tried as an adult. The judge was reprimanded in a 14 page ruling that warned him against showing bias toward privileged offenders.
